My-MixIT is a software platform owned and operated by Random Software Ltd (RSL) on behalf of Akzo Nobel Coatings Limited (AkzoNobel). It collects data from the intelligent scale PC systems of AkzoNobel customers and provides them with that information in report form using a convenient web portal that can be accessed from any web browser without having to visit the mixing room in person.

The following terms and conditions apply to your use of the My-MixIT website application. Acceptance of these terms and conditions grants you a temporary license to use the site. In order to use My-MixIT, you will be required to acknowledge acceptance of these terms the first time you log into the site. If you are not in agreement with these terms you may not use the site and must contact AkzoNobel for more information. These terms can be accessed at any time from the login page by clicking on the link prior to logging in.

Access to My-MixIT is provided via a secure login username and password. The site is only accessible by first obtaining a login username and password from AkzoNobel. Please note that both AkzoNobel and RSL staff will have full access to the system and all information at all times.

Your secure username and login information provided must be kept confidential at all times from all parties. It must not be provided to any other party, additional logins can be provided to your members of staff within your business on request, should the need arise.

The My-MixIT website uses cookies. By using this website and agreeing to these terms and conditions, you consent to the use of cookies in accordance with the terms of our privacy policy / cookies policy stated later in this document.

RSL owns the intellectual property rights to this website and associated applications. The data stored in the system provided by AkzoNobel for use by the My-MixIT system and the domain name My-MixIT.com and the names Mixit, MixitPro and My-MixIT remain the property of AkzoNobel.

Using the system you are able to access and download a range of information. You may, when prompted, print, view or download this data for your own use within the course of your business relating to AkzoNobel. The following restrictions apply to the use of data accessed through My-MixIT.

• Data may not be supplied to any third party under any circumstances.
• Data may not be uploaded or re-published onto another website or location without first obtaining the written permission of AkzoNobel.
• Data may not be resold, rented or re-licensed to any other party.
• Data may not be reproduced, copied or used for commercial gain.
• Data may not be edited when downloaded or reproduced in a manner which does not reflect the original source information detail.

At all times, the My-MixIT system may not be used in any way that can or may cause damage to the website and/or its accessibility. My-MixIT may not be utilised in any way which is unlawful.

The My-MixIT system must not be used to copy, store, host, transmit, send, use, publish or distribute any material which maybe related to or contain, whether directly or indirectly, such items as spyware, computer viruses, Trojan horse, worm, keystroke loggers, rootkits and other damaging related software or malicious items.

At no time may any automated data analysis, data extraction, data mining software or tools or associated utilities be used on the My-MixIT system. Use of the system is strictly restricted to a single human user per login.

All information contained within the My-MixIT system is provided to authorised users by means of a secure username and password. You may request a change to your password if need be by contacting AkzoNobel. Access to data and reporting information/documents contained within the system is directly specific to your user account profile and status. If at any time you are able to view data from any other site you undertake to not store, reproduce or use the data in any way, and to notify AkzoNobel immediately. The following rights and restrictions apply at all times:

• Site Level User: You will be able to access the standard general documentation stored and available in the My-MixIT system following a successful login. You will also be able to produce a range of data reports based on the information provided from your Mixit Pro Scale System located at your site address. You are not able to access or view information relating to any other End User active on the system at any time.
• Group Level User: In the situation whereby a number of Sites are collectively linked as a Group, a Group Level User may access all information held within My-MixIT as well as produce and review data reports for any of the Sites contained within that Group.
• Country Level User: AkzoNobel and RSL have access to all information, site data and reporting tools at all times. Data accessed will be treated in confidence and not be provided to any external party for any purpose without the express permission of AkzoNobel. In the event that the data is required to support an existing agreement between AkzoNobel, the End user and a third party, for example but not limited to, a vehicle manufacturer or insurer approval program, AkzoNobel may utilise this data in support of such business agreements. RSL will not provide data collated in the My-MixIT system to any third party without receiving written permission from AkzoNobel.

RSL cannot be held liable for the accuracy of such data contained within the reports or associated documents uploaded and accessible in the My-MixIT system.

Any discrepancies found should be reported to AkzoNobel using the contact details at the end of this document, and will be checked and verified and where possible corrections made where the data is under the direct control of RSL.

RSL does not warrant the completeness or accuracy of the information published on this website; nor do we commit to ensuring that the material on the website is kept up-to-date. To the maximum extent permitted by applicable law we exclude all representations, warranties and conditions relating to this website and the use of this website (including, without limitation, any warranties implied by law of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill).

RSL will not be held liable to any extent for any loss or damage of any nature resulting in the use of the My-MixIT system and its associated data. RSL will not be liable to you in respect of any losses arising out of any event or events beyond its reasonable control in the use of the My-MixIT system and its information.

RSL is not liable with respect to any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill at any time. Neither is RSL liable for any special, indirect or consequential loss or damage at any time.

All users of the My-MixIT system hereby indemnify RSL and undertake to keep them indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by RSL to a third party in settlement of a claim or dispute on the advice of their legal partners), where the losses are incurred or suffered from any breach by a user of any provision of these terms and conditions, or arising out of any claim that a user may have breached any provision of these terms and conditions.

Without prejudice to RSL’s other rights under these terms and conditions, if any user breaches these terms and conditions in any way, appropriate action may be taken to deal with the breach, including suspending a user’s access to the website, prohibiting a user from accessing the website, blocking computers using the IP address from accessing the website, contacting a users internet service provider to request that they block the users access to the website and/or bringing court proceedings against the user.

From time to time, these terms and conditions may be revised. Such revised terms and conditions will apply to the use of the My-MixIT website from the date of the publication of the revised terms and conditions on the website. You will be advised of such a change when you next visit the site at which point a message on screen will inform you of a change and the opportunity to review these updated terms, which must be acknowledged prior to logging in to the My-MixIT system.

RSL may transfer, sub-contract or otherwise deal with the rights and/or obligations under these terms and conditions without notifying you or obtaining your consent, providing this does not result in an interruption of service and continuity of the My-MixIT system.

No licensed party or user may transfer, sub-contract or otherwise deal with these rights and/or obligations under these terms and conditions without the prior written approval of both RSL and AkzoNobel.

If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

These terms and conditions in conjunction with the following policies on privacy, cookies, anti-spam and disclaimers constitute the entire agreement between RSL and the users of the My-MixIT system and supersede all previous agreements and terms and conditions in respect to the use of the My-MixIT system.

• Cookies Policy : The website uses cookies solely for the purpose of allowing an End User of AkzoNobel user to store their login information. This may include third party cookies.
• Linking Policy : The My-MixIT system may contain links to other websites that an End User is permitted to click on and browse. These links are authorised by RSL and AkzoNobel only and are directly related to the areas of business conducted by either party relative to the End User.
• Ownership of copyright : The copyright in this website and the material on this website (including without limitation the text, computer code, artwork, photographs, images, music, audio material, video material and audio-visual material on this website) is the property of RSL.
• Enforcement of copyright : RSL takes protection of copyright very seriously. If it is discovered that another party has used the copyright materials in contravention of the licence above, legal proceedings may be taken against you seeking monetary damages and an injunction to stop you using those materials. You could also be ordered to pay legal costs. If you become aware of any use of RSL copyright materials that contravenes or may contravene the licence above, please report this immediately by email to legal@randomsoftware.net
